The new Swiss Data Protection Act, which came into force in September 2023, brings significant changes for companies.
Here are the main consequences:
- Extended transparency and information obligationsCompanies must inform their customers and users clearly and comprehensively about how their data is collected, used and stored. This increases the effort required to create and maintain data protection declarations and information materials.
- Stronger rights for those affectedIndividuals receive extended rights regarding their data, such as the right of access, rectification, erasure and data portability. Companies must set up systems and processes to be able to fulfil these requests efficiently.
- Data protection impact assessmentsWhen introducing new technologies or processes that pose a high risk to the privacy of data subjects, companies must carry out a data protection impact assessment. This requires additional resources and expertise in the area of data protection.
- Stricter sanctionsViolations of the new law can lead to heavy fines. This means that companies need to seriously review their data protection practices and ensure that they are compliant to avoid financial and reputational damage.
- Appointment of a data protection adviserData protection advisor: Above a certain size or in the case of extensive data processing, it may be necessary to appoint a data protection advisor to ensure that all data protection requirements are met.
Overall, these changes increase the administrative and financial burden for companies, require greater integration of data protection measures into operational processes and lead to a higher risk of non-compliance.
